Car 2 Home Terms of Service
Version 1.1, effective May 5, 2026
Article 1. Purpose
The purpose of these Terms is to establish the rights, duties, responsibilities, and other necessary matters between the Company and its members regarding the use and provision of the Car 2 Home services.
Article 2. Definitions
① Car 2 Home Service: a driver convenience service provided by the Company through mobile applications and the web page (https://www.car2home.ai). It is a comprehensive vehicle information service that provides users with vehicle related information, operation statistics, consumable management, real time dashboard functions, and home automation integration features (collectively the "Service").
② Member: a person who has registered by accessing the mobile application or webpage and provided personal information in accordance with these Terms, and who is authorized to use the Service.
③ On Board Diagnostics (OBD): refers to a terminal device (the "OBD terminal") that the member installs in the vehicle's OBD port at their own expense and responsibility in order to receive the Company's services. The OBD terminal is a third party or user owned device and is not provided by the Company.
④ Posts: texts, photos, videos, files, and links posted by members on the Service.
⑤ Server: a computer system that manages and discloses information to authorized users. In the context of this Service this includes both the Company's infrastructure and the member's personal home automation server, as applicable.
⑥ Subscription Product: a recurring automatic payment or fixed rate subscription plan for each period, purchased to access the full features of the Service.
⑦ Subscription Member: a member who has purchased a Subscription Product and may use the Service without restrictions during the active subscription period.
Article 3. Effect and Change of Terms
① These Terms become effective when posted on the service screen or disclosed to users. Members who agree to these Terms may register and use the Service.
② The Company considers that a member has read and fully understood these Terms when the member indicates consent on the Company's website or application.
③ The Company may amend these Terms to the extent that it does not violate applicable laws, including the Brazilian Consumer Defense Code (Lei nº 8.078/90, CDC), the Brazilian Internet Civil Rights Framework (Lei nº 12.965/2014, Marco Civil da Internet), and the General Personal Data Protection Law (Lei nº 13.709/2018, LGPD). Amendments will be announced on the Service screen at least 30 days before the effective date. For amendments that are unfavorable to members, additional notice will be provided via email or in app notification.
④ If a member does not express their refusal within the notice period after the Company has clearly communicated the amended Terms, the member will be deemed to have agreed to the amended Terms. Members retain the right to refuse the amended Terms and, in doing so, may terminate their use of the Service as described in Article 5.
⑤ Members have the right to disagree with amended Terms. If they do not agree, they may stop using the Service and terminate their Car 2 Home account.
Article 4. Membership and Account Registration
① A user becomes a member after completing the authentication procedure set by the Company and agreeing to these Terms. Authentication is only required once, upon first registration, and is required only when the user chooses to subscribe to a paid plan.
② The Company authenticates users through Google and Apple single sign on systems. No separate username or password is required. Sign in is optional and used solely to associate a paid subscription with a portable identity across devices.
③ During authentication, the member's identifier, email address, and display name from their Google or Apple account are stored in accordance with our Privacy Policy (available at www.car2home.ai/privacy).
④ All personal information is collected, stored, and used in accordance with the Car 2 Home Privacy Policy and applicable data protection laws, including the LGPD (Brazil) and the GDPR (European Union), where applicable. Members may request access, correction, or deletion of their data at any time by contacting privacy@car2home.ai.
⑤ Vehicle data read by the OBD terminal is processed locally on the member's device and, where configured by the member, transmitted to their personal home automation server. The Company does not store OBD or vehicle data on its own servers. For details, refer to Section 3 of the Privacy Policy.
⑥ Records related to the member's account (such as account information and app preferences) are stored on the Company's servers while the account is active. Upon account termination or after 1 year of inactivity, personally identifiable information will be deleted in accordance with the Privacy Policy. Anonymized and aggregated statistical data may be retained for service improvement purposes.
⑦ The Company shall not approve a registration if the applicant:
- Was previously disqualified from membership under Article 5, Paragraph 1;
- Has submitted false or third party information;
- Has not met the required conditions for service registration, including refusal to consent to required data collection and processing;
- Is under 18 years of age.
⑧ The Company shall not be held liable for any consequences arising from registration using stolen identity or fraudulent information. Accounts registered with another person's information will be immediately deleted and may be reported to the appropriate authorities.
Article 5. Loss of Membership
① The Company may restrict, suspend, or terminate a member's account if the member:
- Interferes with other users' use of the Service, steals information, or otherwise threatens the integrity of the Service;
- Uses the Service in violation of applicable laws or these Terms, or in a manner contrary to public order and morals.
The Company will, whenever possible, provide the member with an opportunity to respond before taking such action.
② Upon account termination, personally identifiable information will be deleted in accordance with the retention schedule defined in the Privacy Policy. Anonymized vehicle operation statistics may be retained for service improvement and business purposes.
Article 6. Notifications to Members
① The Company may notify members via email, in app notification, or other available means.
② For notices directed at a large number of unspecified members, the Company may substitute individual notification by posting a notice in the Service's notification section for at least 30 days.
Article 7. Service Content
① The specific content of the services available to members is described in the Service description published at www.car2home.ai.
② The Company may modify part or all of the Service after providing prior notice to members in accordance with Article 6.
Article 8. Service Availability
① The Service is generally available 24 hours a day, 7 days a week, except during scheduled maintenance windows or other necessary interruptions.
② The Company may temporarily suspend the Service in the following cases, with advance notice to members where possible:
- Scheduled or emergency system maintenance;
- Service disruptions due to fire, power outage, or similar events;
- Natural disasters (earthquake, flood, storm, etc.);
- War, civil unrest, labor disputes, or other force majeure events;
- Suspension of telecommunications services by a provider;
- Failure of the user's OBD terminal device;
- Other cases where temporary suspension is deemed necessary for operational or technical reasons.
③ If advance notice is not possible due to unforeseen technical failures, the Company will notify members as soon as practicable after the event.
④ The Company does not provide separate compensation for damages resulting from service interruptions under Paragraphs 2 and 3, unless otherwise required by applicable law.
Article 9. Member Responsibilities
① If a member discovers that their personal information has been used illegally in connection with the Service, they must promptly notify the Company.
② Members must comply with these Terms and all applicable laws.
③ Members are responsible for any use of the Service through their account by third parties. Members are responsible for maintaining the security of their Google and Apple accounts used to access the Service.
④ Members may not use the Service for commercial profit without prior written approval from the Company. Use by businesses for commercial fleet or operational purposes is not permitted under a standard membership and requires a separate commercial licensing agreement with the Company (see Article 16).
⑤ Members may not copy, reproduce, distribute, or publish any content from the Service that is protected by copyright, trademark, patent, or other intellectual property rights.
⑥ Vehicle data provided by the Service is obtained through a process of collection, processing, and transmission via the OBD terminal and the member's device. Due to the nature of OBD communication and the variability between vehicle manufacturers, models, and firmware versions, the data displayed in the Service may differ from the information shown on the vehicle's own dashboard or instruments. These differences are inherent to the technology and are not errors attributable to the Company. Members acknowledge and accept this limitation.
⑦ Sensor values that are calculated or estimated by the Service (such as fuel efficiency, smart driving scores, or derived metrics) depend on information correctly entered by the member during registration and vehicle profile setup, including but not limited to vehicle model, engine displacement, fuel type, and tank capacity. The accuracy of these calculated values is directly dependent on the correctness of the data provided by the member. The Company assumes no liability for inaccurate calculated results arising from incorrect or incomplete profile information provided by the member. These values are provided for informational and non professional purposes only.
⑧ If a member wishes to delete their personal information and service records, they must submit a deletion request by contacting support@car2home.ai or through the account settings within the app. The Company will process the request in accordance with the Privacy Policy and applicable law.
⑨ Important use notices: the App must not be operated while driving, since handling a phone behind the wheel is dangerous and prohibited by traffic laws in most jurisdictions; the member alone is responsible for compliance. The Company is not liable for any damage to the member's phone or vehicle arising from misuse. Because the market offers thousands of phone, vehicle and OBD adapter models, including many low quality or counterfeit OBD-II adapters, full compatibility cannot be guaranteed and occasional inconsistencies may occur. If the vehicle shows any malfunction or fault, the member is encouraged to consult a qualified automotive professional; the Service is informational and is not a substitute for professional diagnostics or repair.
Article 10. Intellectual Property
① Copyrights and other intellectual property rights for all content and software created by the Company belong to the Company.
② Members may not use, copy, transmit, publish, distribute, or broadcast any content obtained through the Service for commercial purposes without prior written consent from the Company.
Article 11. Member Generated Content
① Copyrights for content created and posted by members belong to the respective members.
② If a member's post contains content that violates applicable law, including copyright or data protection regulations, the rights holder may request suspension or deletion of the content, and the Company will act accordingly.
③ Even without a rights holder's request, the Company may take temporary measures against content that violates these Terms or applicable law.
Article 12. Dispute Resolution
The Company shall give priority to complaints and suggestions submitted by members when deemed justified. If prompt resolution is not possible, the Company will inform the member of the reason and an expected resolution timeline.

Article 13. Governing Law and Jurisdiction
① These Terms are governed by the laws of the Federative Republic of Brazil, where the Company is established. This choice of law does not deprive members of the protection afforded by the mandatory consumer protection rules of their country of residence, which prevail over these Terms whenever they grant the member greater rights.
② Disputes between the Company and a member shall be resolved before the courts having competent jurisdiction under the mandatory consumer protection rules applicable to the member. Consumers residing in the European Union may bring proceedings in the courts of their Member State of residence, as provided by Articles 17 to 19 of Regulation (EU) 1215/2012 (Brussels I bis). In the absence of any such mandatory rule, disputes shall be resolved before the courts of the District of São Paulo, State of São Paulo, Brazil.
③ Before initiating legal proceedings, both parties agree to attempt to resolve any dispute in good faith through direct negotiation for a period of at least 30 days.
Article 14. Compensation for Damages
① If a member causes damage to the Company through a violation of these Terms, the member shall be liable to compensate the Company for such damages.
② If the Company incurs claims, damages, or legal costs from third parties due to a member's illegal acts or breach of these Terms, and the Company is not found to be at fault, the member must indemnify the Company.
③ If the Company violates these Terms or applicable law and causes damage to a member, the Company shall be liable for such damages unless it can demonstrate that the damage was not caused by intentional or negligent conduct on its part. The Company is exempt from liability for the following indirect damages:
- Business losses resulting from the use of the Service;
- Business losses resulting from the unavailability of the Service;
- Indirect damages resulting from the use of third party services integrated with the Service.
Article 15. Exemption of Liability
① The Company is exempt from liability in cases where the Service cannot be provided due to natural disasters, force majeure events, or circumstances beyond its reasonable control.
② The Company is not responsible for service failures or interruptions caused by reasons attributable solely to the member.
③ The OBD terminal used to connect to the vehicle is either a third party device or owned by the member. The Company does not manufacture, supply, or warrant any OBD terminal. The operation, maintenance, compatibility, and safety of the OBD terminal are the sole responsibility of the member or the terminal manufacturer. The Company assumes no liability for service failures, data inaccuracies, vehicle damage, or any other consequence arising from the malfunction, incompatibility, or improper use of the OBD terminal.
④ The Company assumes no liability for the security, availability, or integrity of data transmitted between the Car 2 Home App and the member's personal home automation server or MQTT broker. The security of that infrastructure is entirely the member's responsibility, as described in the Privacy Policy.
Article 16. Suspension of Service Access
① The Company may suspend a member's account access in the following cases:
- When it is confirmed that registration was made using another person's identity or false information;
- When a member violates the obligations set forth in these Terms.
Before suspending access, the Company will notify the member via email or in app notification, where technically feasible, providing the reason and an opportunity to respond.
② If the Company amends major policies or Terms with prior notice and the member does not agree to the updated Terms, the member may reject them by ceasing to use the Service or deleting the app before the notice period expires.
③ Use of the same account on more than three (3) devices simultaneously is not permitted under a standard membership. If such usage is detected, the Company may restrict access to paid subscription and in app purchase features on devices beyond the third. The member will be notified by email or in app notification before or immediately upon such restriction being applied. Repeated violations may result in account termination.
④ Commercial and Fleet Use: the Car 2 Home Service under a standard membership is intended for personal, non commercial use only. Use of the App by companies or individuals managing a vehicle fleet for commercial or operational purposes is not permitted under a standard account.
Companies or users with fleet requirements who wish to use the App across multiple vehicles or for commercial purposes must contact the Company to enter into a separate commercial licensing agreement:
Unauthorized commercial use may result in immediate account suspension without prior notice.
Article 17. Suspension or Termination of Service
The Company may suspend or terminate the Service by notifying members via any available means, clearly stating the reason and the effective date, in any of the following situations:
① It becomes significantly difficult to continue providing the Service due to changes in the business environment or technological developments;
② The Service cannot continue due to regulatory decisions, court orders, or administrative actions by competent authorities;
③ Continuation of the Service becomes impossible due to war, natural disaster, or other force majeure events.
Article 18. Supplementary Rules
For matters not addressed in these Terms, the following Brazilian laws apply, as well as any applicable international regulations depending on the member's country of residence:
- Consumer Defense Code (Lei nº 8.078/1990, CDC)
- Marco Civil da Internet (Lei nº 12.965/2014)
- General Personal Data Protection Law (Lei nº 13.709/2018, LGPD)
- Electronic Commerce Regulation Decree (Decreto nº 7.962/2013)
For members located in the European Union, GDPR and applicable EU consumer protection directives also apply.
Article 19. Payment
The Company may decline or cancel payment approval in the following cases:
- The fee is not paid or the payer cannot be identified;
- A payment method belonging to a third party is used without their authorization;
- The purchase is made using a false identity or fraudulent information;
- Approval is otherwise impossible due to reasons attributable to the member or applicable law.
If a service failure occurs on the Company's side, payment approval may be withheld until the issue is resolved.
Subscription products are offered in 3, 6, and 12 month periods. From the start of the subscription, payments will be charged automatically at each renewal unless automatic renewal is cancelled by the member before the renewal date.
Article 20. Cancellation and Refund Policy
① Right of Withdrawal (Cooling-off Period): members who purchase a subscription product remotely have the statutory right to withdraw from the purchase within the period established by the mandatory consumer protection law of their country of residence. Recognized withdrawal periods include, without limitation:
- Brazil: 7 (seven) calendar days from the date of the transaction, under Article 49 of the Consumer Defense Code (Lei nº 8.078/1990, CDC).
- European Union and European Economic Area: 14 (fourteen) calendar days from the date of the transaction, under Directive 2011/83/EU, provided the service has not been fully performed with the member's prior express consent.
- Other jurisdictions: the period established by the applicable local law.
To exercise this right, contact support@car2home.ai within the applicable withdrawal period. The refund will be processed through the original payment method.
② Cancellation of Recurring Subscriptions: members may cancel automatic renewal of a subscription at any time through the app store platform (Google Play or Apple App Store) used to make the purchase. Upon cancellation, no further charges will be made, and the member will retain access to the Service until the end of the current paid period. No partial refund will be issued for the remaining unused period of an active subscription term, except where required by applicable law.
③ Gift and Promotional Items: purchases of gift items or promotional products are non refundable. The Service will remain available to the recipient until the end of the applicable contract term.
④ Refund Denial: the Company reserves the right to deny a refund if the member has been found to have committed serious violations of applicable law (including copyright, software protection, or data protection regulations) or of these Terms, resulting in account restriction or termination. This exception does not apply if the member demonstrates that no such violation occurred.
⑤ Refund Processing: approved refunds will be processed through the original payment method within a reasonable period, subject to the payment provider's processing times. For refund requests or disputes, contact: support@car2home.ai.

The Car 2 Home Service currently includes the following features, which may vary by subscription tier and platform availability:

- Management of consumables and fuel and maintenance costs
- Integration with home automation platforms
- Support for multiple vehicles, multilingual interface, and multiple unit systems
